    98's Apartment Fire - 9-16-08

    Very good job to all the men and women at Colonial Gardens last night.  It's been a while since Morrisville had a good working apartment fire, and from what I heard, it sounded like it went smoothly.  I heard the call go out loud and clear - but I am curious to know, did I hear correctly that there were two people entraped?  Also, how many companies were sent to the call?

     Anymore information/pictures would be awsome to see.

    Kudos to the members of Station 98 who made the rescues!

    TRENTON - A volunteer Falls Township, Pa., firefighter who helped carry an unconscious woman from a killer apartment fire early Tuesday has been fired from his day job after revealing he suffered a hernia in the rescue effort.

    Dustin Zeek, 23, of the Falls Township Fire Department, and other firefighters pulled Wesley McKinnon, 21, and his girlfriend, Whitney Sanders, out of their burning, smoky unit at Colonial Gardens at 490 Plaza Blvd. in Morrisville, Pa.

    (McKinnon on Thursday died in Temple University Hospital's intensive burn-care unit, where Sanders was in stable condition last night.)

    "Due to me helping take the victim out of the fire, I suffered a hernia," Zeek told The Trentonian yesterday.
    "I realized it the next morning. And I went to work, and I worked a full day Wednesday."

    Zeek said he didn't know what a hernia was - "it felt like cramps," he said - while he was at his job as a fire extinguisher technician with J. W. Kennedy Inc., a fire protection company at 536 Perry St. in Trenton.

    "So I went and checked with the (Falls) firehouse after work, and they sent me to the hospital, and the hospital put me out on light duty, so I was able to attend fire classes," Zeek said.

    Under light duty, he isn't allowed to lift anything over 5 pounds nor allowed to bend and twist and squat. Fire extinguishers, which he handles during worksite inspections, weigh 20 pounds.

    The next day, Zeek turned the hospital paperwork in at J.W. Kennedy, "and they told me there is no light duty; unfortunately, we have to get rid of you," he said.

    He quoted company owner Jack Kennedy as telling him, "I'm sorry that I have to do this, but we're going to have to let you go. We spoke to our attorneys, and our attorneys stated that if you were to hurt yourself worse, at work, then we're liable for getting sued. There is no light-duty for this business, so in that case we're going to have to let you go."

    "And he gave me a letter," Zeek said.

    The letter states Zeek could be rehired when he is healthy again - if a job opened existed at that time (see the complete letter in the sidebar).

    "I asked, 'Are you allowed to do that?' being I am on Workman's Comp? And that's when he said, 'My attorneys advised me that I can.' "

    Zeek said Workman's Comp pays him for all the time he's out of work and his medical bills. The company is supposed to hold his position until he's healthy again, he said. "And instead, they fired me. By law they're not allowed to fire me."

    Kennedy told The Trentonian he's not responsible for injuries suffered by a volunteer fireman at a fire job and noted that Zeek is covered by Workman's Comp through the Falls Township Fire Company for those injuries.

    Kennedy also said that if Zeek were allowed to continue work at J.W. Kennedy, he could become more seriously injured there, and then he would be responsible.

    Would the reporter take on that responsibility, that liability, Kennedy asked? If so, he said he would be glad to have Zeek on the job. "Would you want to be liable?" he asked again.

    A reporter tried to ask whether a fireman who heroicly helped save a life shouldn't catch a break, but Kennedy cut in: "Don't pull that on me. I'm with the Yardley-Makefield Fire Company - I'm a firefighter myself."

    Zeek said he faces surgery within two weeks, and will likely be out of work an additional month with the healing process.

    being a member of a fire company for +/- 40 years your one of the business people who should show support for a hurt worker (firefighter) but instead you turn your back and let him go. shame on you and your business and for mentioning what dept you belong too. anyone who's company uses kennedy as their extingusher provider should look for a new company including the company he belongs to, if they haven't already. i'm sure he'd be singing a different tune if his son who is employed by trenton FD dumped him after he got hurt.

    HHM, You hit the nail on the head, if we are treated like this by fellow firefighters what do you really think the others will do. FF Zeek did what we all train to do and did it well. How the hell in todays world of volunteers do you get fired for this action. The one thing I hope is that the company that Jack runs with doesn't take the hit for this. It is a damn shame but I believe there are more like him out there with us where the heck is the brotherhood! I have known Zeek since he was a kid and went to school with my kids he might have gone to FF1 with my daughter I hope this doesn't change your opinion of the volunteer fire service but honestly I wouldn't blame you if it did. This is making me wonder why we do this as volunteers do you all think this would happen to a paid guy?

    I also know some of the Chiefs and FF group read these posts how about making a stand with the politicians and fix this problem, I know that I am not politically correct but I sure as hell will be talking to Larry Glick when I get back next week!

    This isn't a good thing to happen to this firefighter, or any firefighter who may be in a similar situation.  It may be what a lawyer suggests, but that doesn't mean it is the right thing to do.

    I know we have at least a couple lawyers who visit here, so maybe they can give an opinion.  I know you can't get fired if you are out on workers comp from being injured at your job.  But that isnt the case here, he wasnt hurt at work, he was hurt outside of work.  So, that is where vagueness comes in.  Does workers comp. protect his job in this situation?  Does workers comp continue to pay him until he find new employment?  If it protects his job and this SOB lets him go, he should sue the pants off of him.

    In the part about coming to work and getting hurt worst, I never had a hernia, but I would think if you need surgery, it cant get that much worst.  So, he couldnt find some shop work or something to do for a couple weeks to get him through this?

    And finally, I would hope the members of Yardley-Makefield ride his ass good for this.  To the point where in his next interview, he says, "dont give me that, I WAS a member of a volunteer fire company before.

    That really is a horrible situation!! Here is what I've come up with from an attorney friend. Your employer MAY fire you for violating the absenteeism policy, if in fact, there is one in place at your place of employment. Here is a web site that may offer some assistance to the young fellow if someone could get it to him. http://www.workcomplegalcenter.com/index.html?ref=http%3A//www.ask.com/web%3Fo%3Dsb%26l%3Domws%26q%3DWorkmans+comp+for+volunteer+firefighters. These attorneys are very good and only deal with situations like his and they won't charge for consultation. It's hard to believe this is a firefighter owned business!! What about looking out for one another?? I couldn't agree more Dave!! I'll be praying for the youngster. Here's another one for you from our department!! This 18 year old girl is suing our department for cutting off her $50 Hollister sweatshirt after she overdosed on heroin, was found unconscious, shocked twice by our department members with our AED, given CPR and had her life saved. This world is really getting sick with  these attorneys (some, not all) suing for every little thing. We were sued last year after returning from a truck fire, while backing into quarters, got hit for a full arrest, arrived 1st, shocked patient with AED and did CPR, saved his life, his wife sued for carpet cleaning!!! I hope all is well back East and I pray daily for all of you, Bob.

    I have known Dustin since he was a baby, he is a very good kid and i'm sorry to hear this happened to him.I know when i was hurt  responding to a fire and was on workman's comp the company i worked for held my job while i was out and i returned with no problems at all. I guess it all depends on what type of company and management you work for whether they respect  you enough to keep your job.Knowing this is a fellow firefighter he should be ashamed of himself for not having a little compassion for a fellow firefighter and find some kind of light duty for him whether they have it or not,let him file papers or do some type of office or shop work.

    Good hearing from you Rick, hope all is well. Yeah, I agree, a fire extinguisher company, hmmm. He could fill cartridges, take orders, probably do alot around the shop, even go out to do his regular job with the exception of carrying the extinguisher itself. I also agree with Dave, you can't judge this guys department by the decision of 1 fellow. Yardley seems to be a well liked department. If we judge other department based on 1 guy or a group of guys, the whole country would be in trouble!!. I pray that this is resolved amicably, by both parties. How often in your volunteer career do you make a save like this. Its not like he did anything intentionally. What if this were a relative to his boss?? I think and pray this can be put to rest. Stay safe folks, Bob.

    This is a crap situation and i hope all works out for Dustin. I would also like to say Kudos to him and everyone else. That is strong work what they did pulling those people out and then providing care on the outside. Once again great work work gents.
